General Terms and Conditions of Sale

Article 1 — Purpose

These general terms and conditions of sale (hereinafter "GTC") govern the contractual relationship between ELECTRO PO SASU, a SASU (simplified single-shareholder joint-stock company) with a share capital of 10 000,00 €, registered in the Perpignan Trade and Companies Register under number 917 769 085, with its registered office at Centre Commercial Frunshopping ZAC Creu Blanca A l'Angle du Chemin Rural, 6, 66450 Pollestres, France (hereinafter "ELECTRO PO" or "the Seller"), and any adult natural person, acting as a non-trader in the capacity of consumer within the meaning of the introductory article of the Consumer Code, making a purchase on the website www.electropo.fr (hereinafter "the Customer").

The GTC apply to all sales concluded remotely via the website www.electropo.fr, to the exclusion of all other terms. They are accessible at any time on the website and prevail over any other version or contradictory document.

Article 3 — Acceptance of the GTC

The validation of an order on the website constitutes full and unreserved acceptance of these GTC by the Customer, who acknowledges having read them prior to concluding the contract. The validation checkbox provided at the end of the purchase process constitutes electronic proof of the Customer's consent within the meaning of Articles 1366 and 1367 of the Civil Code.

Article 4 — Products

The products offered for sale are those presented on the website www.electropo.fr on the day of consultation, subject to available stock. The essential characteristics of the products (brand, model, dimensions, power, capacity, materials) are stated on each product page. The photographs illustrating the products have no contractual value and may show slight variations from the delivered product.

ELECTRO PO SASU is an independent reseller of the brands presented and is not affiliated with the manufacturers. The technical specifications indicated are those provided by the manufacturers.

Article 5 — Prices

Prices shown on the website are in euros, inclusive of all taxes (VAT included), including VAT at the applicable legal rate, as well as, where applicable, the WEEE eco-contribution (waste electrical and electronic equipment) shown separately in accordance with Article R541-88 of the Environmental Code. Delivery charges are indicated prior to order confirmation and are invoiced in addition.

ELECTRO PO SASU reserves the right to modify its prices at any time. Products will be invoiced on the basis of the rates in force at the time of order confirmation, subject to availability.

Article 6 — Order

The Customer places an order following these steps: (1) selection of products and addition to the cart; (2) review of cart contents; (3) entry of delivery and billing details; (4) choice of delivery method; (5) choice of payment method; (6) confirmation of the order after acceptance of the GTC and the Privacy Policy; (7) receipt of a confirmation email detailing the order.

The order is deemed final only after payment confirmation from the banking institution and dispatch of the confirmation email by ELECTRO PO SASU.

Article 7 — Payment

Accepted payment methods are: SEPA bank transfer and credit/debit card (Visa, Mastercard). Card payments are processed via a secure gateway compliant with the PCI-DSS standard. ELECTRO PO SASU does not store any banking data belonging to the Customer.

In the event of payment by bank transfer, the banking details are communicated to the Customer upon completion of order validation. Parcel preparation begins upon actual receipt of funds.

Article 8 — Invoicing

An invoice is issued for each order and sent to the Customer by email in PDF format, together with the confirmation email. The invoice may also be downloaded from the customer account area. Any request for professional invoicing with an intra-community VAT number must be made before the order is finalised.

Article 9 — Delivery

Delivery terms (areas served, carriers, timescales, charges) are detailed in the Delivery and Returns Policy. The indicative delivery period runs from payment confirmation. The maximum statutory delivery period is thirty (30) days from the conclusion of the contract, in accordance with Article L216-1 of the Consumer Code, unless otherwise agreed by the parties.

In the event of a delivery delay, the Customer may, after having called upon the Seller to deliver within a reasonable additional period, cancel the contract by registered letter with acknowledgement of receipt or by email, in accordance with Article L216-6 of the Consumer Code.

Article 10 — Transfer of Ownership and Risk

Transfer of ownership of the product occurs upon full payment of the price. Transfer of the risk of loss and deterioration takes place at the moment when the Customer, or a third party designated by the Customer other than the carrier proposed by the Seller, physically takes possession of the goods, in accordance with Article L216-4 of the Consumer Code.

Article 11 — Right of Withdrawal

In accordance with Articles L221-18 to L221-28 of the Consumer Code, the Customer has a period of fourteen (14) calendar days, from the day on which the product is received, to exercise their right of withdrawal, without having to justify their decision or bear any costs other than those provided for in Article L221-23 of the Consumer Code.

Article 12 — Effects of Withdrawal

In the event of a validly exercised right of withdrawal, ELECTRO PO SASU reimburses the Customer for all sums paid, including standard delivery charges, without undue delay and no later than fourteen (14) days from the date on which it is informed of the Customer's decision. The reimbursement is made using the same payment method as that used for the initial transaction, unless expressly agreed otherwise.

ELECTRO PO SASU may defer the reimbursement until receipt of the product or until the Customer has provided proof of dispatch, whichever occurs first.

The Customer must return the product to ELECTRO PO SASU without undue delay and no later than fourteen (14) days following communication of their decision to withdraw. The direct costs of return are borne by the Customer, except where the product is defective or non-conforming, in which case they are borne by ELECTRO PO SASU.

Article 13 — Exceptions to the Right of Withdrawal

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts relating in particular to: goods made to the consumer's specifications or clearly personalised; goods liable to deteriorate or expire rapidly; goods which have been unsealed after delivery and which cannot be returned for reasons of hygiene or health protection; goods which, after being delivered, have by their nature been inseparably mixed with other items.

Article 14 — Statutory Guarantee of Conformity

All products sold by ELECTRO PO SASU benefit from the statutory guarantee of conformity provided for in Articles L217-3 to L217-17 of the Consumer Code, for a period of two (2) years from the delivery of the goods. This guarantee covers defects of conformity existing at the time of delivery and manifesting within the two-year period, as well as those resulting from defective packaging, assembly or installation where these have been made the responsibility of the Seller.

In the event of a lack of conformity, the Customer has the right to choose between repair and replacement of the goods, subject to the cost conditions provided for in Article L217-12. If neither of these solutions is possible, the Customer may request a price reduction or cancellation of the contract.

Article 15 — Guarantee Against Hidden Defects

Independently of the statutory guarantee of conformity, the Customer benefits from the guarantee against hidden defects provided for in Articles 1641 to 1649 of the Civil Code. They may request the cancellation of the sale or a price reduction, within a period of two years from the discovery of the defect.

Article 16 — Commercial Guarantee

beyond the statutory guarantees, ELECTRO PO SASU does not offer a specific additional commercial guarantee. Certain products benefit from the manufacturer's commercial guarantee under the terms specific to each brand, as specified on the product page.

Article 17 — After-Sales Service

For any request to invoke the guarantee or for after-sales service, the Customer contacts ELECTRO PO SASU at info@electropo.fr. ELECTRO PO SASU undertakes to respond within a maximum period of 48 working hours and to arrange for handling in accordance with the terms described on the Guarantee page.

Article 18 — Liability

The liability of ELECTRO PO SASU shall not be engaged in the event of non-performance or defective performance of the contract attributable to the Customer, to the unforeseeable and insurmountable act of a third party unconnected to the contract, or to a force majeure event within the meaning of Article 1218 of the Civil Code.

Article 19 — Personal Data

Personal data collected at the time of ordering is processed in compliance with Regulation (EU) 2016/679 (GDPR) and the amended French Data Protection Act. The terms of processing are detailed in the Privacy Policy.

Article 21 — Partial Invalidity

Should any provision of these GTC be declared null and void or unenforceable by a final court decision, the remaining provisions shall retain their full force and effect.

Article 22 — Applicable Law and Jurisdiction

These GTC are governed by French law. In the event of a dispute and in the absence of an amicable or mediated resolution, the French courts shall have jurisdiction, without prejudice to the consumer's right, pursuant to Article R631-3 of the Consumer Code and Article 17 of Regulation (EU) 1215/2012 known as "Brussels I bis", to bring proceedings before the courts of the place where they resided at the time of conclusion of the contract or at the time the damage occurred.
