Our Commitment
ELECTRO PO SASU makes available to you the statutory warranties applicable to any product sold to a consumer in France, as well as any commercial warranties that may be offered by the manufacturers whose products we distribute as an independent reseller. The following sections detail each of these warranties, their implementation procedures and the associated after-sales service.
Statutory Warranty of Conformity
Pursuant to articles L217-3 to L217-17 of the French Consumer Code (Code de la consommation), transposing Directive (EU) 2019/771 of 20 May 2019, any product sold by ELECTRO PO SASU benefits from the statutory warranty of conformity for a period of two (2) years from delivery of the goods.
Scope of the Warranty
The seller is obliged to deliver goods conforming to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when such installation was made the seller's responsibility under the contract or was carried out under the seller's responsibility.
Presumption of Non-Conformity
Lacks of conformity that appear within twenty-four (24) months of delivery of the goods are presumed, unless proven otherwise, to have existed at the time of delivery (article L217-7 of the French Consumer Code).
Remedies in the Event of a Lack of Conformity
In the event of a lack of conformity, you have the right to choose between repair and replacement of the goods, subject to the cost conditions provided for in article L217-12. Failing this, you may:
- obtain a reduction in price while retaining the goods;
- or obtain rescission of the contract against return of the goods.
The exercise of the statutory warranty of conformity is free of charge for the consumer: ELECTRO PO SASU covers the costs of transport, labour and spare parts.
Statutory Warranty Against Hidden Defects
Independently of the statutory warranty of conformity, you may choose to invoke the warranty against hidden defects within the meaning of article 1641 of the French Civil Code (Code civil). In such case, you may choose between rescission of the sale or a reduction in price, in accordance with article 1644 of the French Civil Code.
The action arising from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect (article 1648 of the French Civil Code).
Reproduction of Statutory Provisions
In accordance with article R211-2 of the French Consumer Code:
- Article L217-4 of the French Consumer Code: "The goods conform to the contract if they meet, in particular where applicable, the following criteria: 1° They are fit for the use normally expected of goods of the same type..."
- Article L217-5: "In addition to the criteria for conformity to the contract, the goods conform if they meet the following criteria: 1° They are fit for any special purpose sought by the consumer, which was brought to the seller's attention at the latest at the time of conclusion of the contract and which the seller accepted..."
- Article L217-12: "The action arising from a lack of conformity is time-barred two years after delivery of the goods."
- Article 1641 of the French Civil Code: "The seller is bound by the warranty on account of hidden defects in the item sold which render it unfit for the purpose for which it was intended, or which so impair that purpose that the buyer would not have purchased it, or would have paid a lower price for it, had the buyer known of them."
- Article 1648 paragraph 1 of the French Civil Code: "The action arising from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect."
Manufacturer's Commercial Warranty
Certain products sold on www.electropo.fr benefit from a commercial warranty offered by the manufacturer (Cecotec, De'Longhi, Midea, DREO, Comfee, etc.), in addition to and without prejudice to the statutory warranties. The terms of this warranty (duration, scope, procedure) are specified on each product page where applicable.
ELECTRO PO SASU, as an independent reseller, forwards to manufacturers requests for the exercise of the commercial warranty and assists the Customer throughout the procedure.
ELECTRO PO Commercial Warranty
[COMMERCIAL_WARRANTY: ELECTRO PO SASU does not offer a specific commercial warranty in addition to the statutory warranties. This section will be updated if an additional commercial offer is introduced. The only applicable warranties are therefore the statutory warranties described above and the manufacturer's commercial warranties where they exist.]
How to Make a Warranty Claim
For any warranty claim, please follow the steps below:
- Contact our customer service team at info@electropo.fr or by telephone on +33 (0)6 33 32 81 46, specifying: your order number, the name of the product concerned, the nature of the defect, and if possible photographs or a short video illustrating the problem.
- Response within 48 business hours. We will reply within a maximum of 48 business hours with return instructions (label, address, shipping method).
- Coverage of costs. Where the statutory or commercial warranty applies, the costs of return and repair are covered by ELECTRO PO SASU or by the manufacturer, depending on the applicable framework.
- Resolution. Depending on the nature of the defect and the solution adopted, the product will be repaired, replaced or refunded in accordance with the rules set out in the preceding sections.
Exclusions
The following are excluded from the statutory warranty and the manufacturer's commercial warranty, without prejudice to the consumer's legal rights:
- normal wear and tear resulting from use in accordance with the instructions;
- damage resulting from inappropriate use, negligence or accident (dropping, impact, exposure to an unsuitable environment);
- damage resulting from modification, repair or dismantling carried out by an unauthorised third party;
- defects resulting from non-compliant electrical connection (power supply fault, power surge) where this can be demonstrated;
- consumables and wear parts listed on the product page where their replacement is specified.
These exclusions do not in any way affect the consumer's legal rights under the statutory warranty of conformity and the warranty against hidden defects where their conditions of application are met.
