Principle of the Right of Withdrawal

In accordance with Articles L221-18 to L221-28 of the Consumer Code, transposing Directive 2011/83/EU of 25 October 2011 on consumer rights, any consumer who has concluded a distance contract with ELECTRO PO SASU has a period of fourteen (14) calendar days to exercise their right of withdrawal, without having to justify their decision or bear any costs other than those provided for by law.

This right is reserved for natural persons acting for purposes that do not fall within the scope of their commercial, industrial, craft or professional activity.

Start of the Withdrawal Period

The fourteen-day period runs from:

  • receipt of the goods by the Customer or by a third party designated by the Customer, other than the carrier;
  • in the case of staggered delivery of several goods from a single order, from the day of receipt of the last goods;
  • in the case of regular deliveries of goods over a defined period, from the day of receipt of the first goods.

Where the deadline falls on a Saturday, Sunday or public holiday, it is extended to the following working day.

How to Exercise Your Right of Withdrawal

To exercise your right of withdrawal, you must notify us of your withdrawal decision by means of an unambiguous statement before the expiry of the period. You may use one of the following methods:

  • Sending an email to info@electropo.fr, stating your name, address, order number and date of receipt;
  • Sending a letter to: ELECTRO PO SASU, Centre Commercial Frunshopping ZAC Creu Blanca A l'Angle du Chemin Rural, 6, 66450 Pollestres, France;
  • Using the standard form reproduced below.

To comply with the withdrawal period, it is sufficient that you send your communication relating to the exercise of the right of withdrawal before the expiry of the fourteen-day period. The burden of proof of exercising the right of withdrawal lies with you.

Standard Withdrawal Form (Annex I(B) — Directive 2011/83/EU)

This form corresponds to the model provided for in Article L221-5 of the Consumer Code and Annex I(B) of Directive 2011/83/EU. You may copy it, complete it and return it to us by email or by post.

Return of Goods

You must return or hand back the goods to ELECTRO PO SASU without undue delay and, in any event, no later than fourteen (14) days following communication of your decision to withdraw. The deadline is considered met if you return the goods before the expiry of this period.

Return address: ELECTRO PO SASU, Centre Commercial Frunshopping ZAC Creu Blanca A l'Angle du Chemin Rural, 6, 66450 Pollestres, France. We recommend that you choose a tracked delivery method and retain proof of dispatch.

The direct costs of return are fully covered by ELECTRO PO SASU. No return costs will be charged to the Customer.

Condition of Returned Goods

You are only liable for any diminished value of the goods resulting from the handling other than that which is necessary to establish the nature, characteristics and functioning of the goods, in accordance with Article L221-23 of the Consumer Code. Goods used beyond simple handling may give rise to a reduction in the reimbursement.

Reimbursement

ELECTRO PO SASU reimburses you for all sums paid, including standard delivery charges, without undue delay and no later than fourteen (14) days after the date on which we are informed of your decision to withdraw.

Reimbursement is made using the same payment method as that used for the initial transaction, unless expressly agreed otherwise. No charge will be levied against you in connection with the reimbursement.

ELECTRO PO SASU may defer the reimbursement until receipt of the goods or until you have provided proof of dispatch of the goods, whichever occurs first, in accordance with Article L221-24 of the Consumer Code.

If you have expressly chosen a more expensive delivery method than the standard delivery method offered, the additional costs incurred will not be reimbursed.

Penalty for Failure to Provide Information

In accordance with Article L221-20 of the Consumer Code, if the Seller has not provided you with information on the right of withdrawal under the conditions provided for, the withdrawal period is extended by twelve (12) months from the expiry of the initial withdrawal period.

Statutory Exceptions to the Right of Withdrawal

The right of withdrawal cannot be exercised, in accordance with Article L221-28 of the Consumer Code, for contracts relating to:

  • the supply of goods made to the consumer's specifications or clearly personalised;
  • the supply of goods liable to deteriorate or expire rapidly;
  • the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;
  • the supply of goods which, after being delivered, have by their nature been inseparably mixed with other items;
  • the supply of audio or video recordings or computer software unsealed by the consumer after delivery;
  • the supply of newspapers, periodicals or magazines, except for subscription contracts;
  • contracts concluded at a public auction;
  • service contracts fully performed before the end of the withdrawal period and whose performance has begun with the consumer's prior express agreement and express waiver of their right of withdrawal.

Distinction from the Statutory Guarantee

The right of withdrawal is independent of the statutory guarantees of conformity (Art. L217-3 et seq. of the Consumer Code) and against hidden defects (Art. 1641 et seq. of the Civil Code), the invocation of which follows a separate procedure. See our Guarantee page.
